Lawyers Helping Victims Recover Compensation for Brain Injuries in Baltimore

While some people may be able to make a full or partial recovery from serious or catastrophic injuries in a short time, others are not so lucky. Sadly, following the negligence of others, many people suffer traumatic brain injuries (TBIs) that may result in temporary, long-term, or permanent injuries to the victim. While around 75% of TBIs are mild, some injuries are serious enough to leave victims in a coma or a persistent vegetative state.

While many people assume that traumatic brain injuries only occur in serious motor vehicle accidents, that could not be further from the truth. Traumatic brain injuries frequently occur in cases involving medical negligence, aviation accidents, nursing home abuse, sports injuries, product malfunctions, and construction accidents. The effects of these injuries can be widespread, and the fallout may be felt not only by the injured party but also by their family and loved ones tasked with caring for them.

At Silverman Thompson, our attorneys understand the ways traumatic brain injuries can affect victims. In many cases, people may experience problems that affect their emotional regulation, their sensory processing, their ability to speak or understand language, their control over their body, their memory, and more. We work to ensure that victims will be able to receive fair compensation for brain injuries caused by negligence.

Situations Resulting in TBIs

Regardless of the severity of the injuries that resulted in a TBI, if you can prove some amount of damages due to negligence, you can be compensated. Some examples of situations where traumatic brain injuries can occur include:

  • A school-sponsored sports activity leaves a player with a TBI
  • A workplace accident results in a TBI to an employee or customer, leaving them with temporary or permanent physical disability
  • A nursing home employee physically abuses a resident, leaving them with a TBI that affects their physical or cognitive abilities
  • A product malfunctions, leaving the user with a TBI that results in temporary or permanent disability

TBI Resulting in Coma

When a traumatic brain injury occurs and leads to a coma, a victim may be assessed using the Glasgow Coma Scale (GCS). This scale will detail the severity of the coma. Physicians will measure a person's responses to different stimuli, assessing their responses to speech, their reflexes and motor skills, and any movements of their eyes. A score between 1 and 15 will be assigned, with higher scores indicating that a patient is more functional and lower scores indicating a lack of response.

A CGS score of 15 would indicate that a patient is fully functional and awake. If a person is in a deep coma with little response to stimuli, they may receive a score of 4. The specific score can be used to determine the level of care that will be needed and the appropriate treatments that should be provided. It can also help determine what forms of treatment may be necessary if a person emerges from a coma.

As with all our catastrophic injury cases, in cases involving traumatic brain injuries resulting in a coma, our office works with a team of medical experts to analyze how negligence in a particular case resulted in a traumatic injury, while also documenting the lasting effects that the injury will have on the person and their family.
