Baltimore Family Law Appeals Attorneys
Lawyers Helping Clients Appeal Decisions in Family Law Cases in Baltimore, MD
Family courts may address a wide variety of legal issues that affect families, and the parties involved in these cases may not always be satisfied with the decisions that are made or the orders that are put in place. In situations where a person believes that the decisions made in a family law case were incorrect, it may be possible to file appeals.
The process of appealing family law matters can be complicated, and the help of an experienced attorney will be needed to ensure that the right procedures are followed. At Silverman Thompson, our lawyers can help clients understand when appeals may be filed, what steps will need to be taken during their cases, the outcomes that they can expect, and the best strategies for success.
Appeals to the Appellate Court of Maryland and the Supreme Court of Maryland
The team at Silverman Thompson is uniquely equipped to assist with family law appeals to the Appellate Court of Maryland and the Supreme Court of Maryland. Our family law team's litigation experience, combined with our appellate team's knowledge of appellate procedure, creates the ideal legal team for a family law appeal.
Our family law and appellate teams work together to identify potential issues to appeal, prepare the appropriate petitions and briefs, and prepare appellate arguments to maximize your chances of success on appeal.
Administrative/Department of Social Services Appeals
An investigation into allegations of child abuse or neglect by the Department of Social Services (DSS) can result in a finding of "indicated" if DSS concludes that there is credible evidence that the alleged child abuse or neglect occurred, a finding of "ruled out" if DSS concludes that the alleged child abuse or neglect did not occur, or a finding of "unsubstantiated" if DSS concludes there is insufficient evidence to support a finding of indicated or ruled out.
If you disagree with DSS's finding, there is a complex administrative process by which you can appeal the finding. Our lawyers can help you understand the steps to take during this process, and we can advocate on your behalf while fighting to protect your rights.
Appeals of Protective Orders and Peace Orders
If a protective order or peace order is granted or denied by a District Court, either party can appeal to the local Circuit Court. Appeals of protective orders or peace orders to the Circuit Court are subjected to a de novo (a Latin term meaning "from the beginning") standard of review. This means that the Circuit Court will hold a new hearing to determine whether to grant or deny a final protective order or final peace order, rather than deciding whether the District Court erred in granting or denying the protective order or peace order.
Our team has experience handling legal issues related to these types of orders, and we can provide representation during appeals. We can help people who have experienced domestic violence or whose safety is at risk defend protective orders or peace orders, or we can work with those who have been accused of abuse to have protective orders or peace orders lifted.
